ARTICLE XXXII.

  Representative Capacity of the Local Union 

Section 1.

Every member, by virtue of his/her membership in this Local Union, authorizes this Local Union to act as his/her exclusive bargaining representative with full and exclusive power to execute Labor Agreements with his/her employer governing terms and conditions of employment and to act for him/her and have final authority in presenting, processing and adjusting any grievance, difficulty or dispute arising under any Labor Agreement, Understanding or Resolution or out of his/her employment with such employer in such manner as the Local Union or its officers deem to be in the best interests of the Local Union, all subject to Article XII and other applicable provisions of the International Constitution relating to such matters.  The Local Union and its Officers, Business Representatives and Agents may decline to process any grievance, complaint, difficulty or dispute if in their reasonable judgment such grievance, complaint of dispute lacks merit.  The provisions of Article XVI, Section 4 of the International Constitution relating to area, multi-area, national, company-wide or industry-wide contract shall supersede any provision of this Section in conflict therewith.

 

 

Section 2.

Grievances when properly referred to the Business Representative of the Union, i.e., the Business Representative assigned to handle the affairs of the Shop or Industry Unit involved, must have been processed by the Shop Stewards under the steps provided for to adjudicate disputes or grievances in their particular Labor Agreement, Understanding or Resolution with their Employer.  Such grievances shall be in writing and in triplicate copies, the original shall be forwarded by the Shop Steward or Grievance Committee to the Employer Representative having the authority to process such grievances; one copy shall be retained by the Shop Steward of the crew or unit and one copy shall be forwarded to the Business Representative assigned to the unit.  The grievance shall be properly worded and signed by the complaining individual showing the settlement requested. Copies of resolved grievances or resolutions of the same shall be kept on file at the Local Union office by the Business Representative assigned to handle the affairs of the particular shop or industry unit filing such grievances.
